This is a translation of our Dutch terms and conditions. In case of differences, the Dutch version prevails.

Article 2 – Definitions

In these terms: Trader: Magnetenspecialist Import & Export B.V. Customer: any natural or legal person entering into an agreement with Magnetenspecialist. Consumer: a natural person acting for purposes outside their trade, business or profession. Business customer: any natural or legal person acting in the course of a profession or business. Agreement: any agreement between Magnetenspecialist and the customer.

Article 3 – Applicability

These terms apply to all offers, orders, agreements and deliveries of Magnetenspecialist. Deviations are only valid if agreed in writing. Any general terms of the customer are expressly rejected, unless agreed otherwise in writing.

Article 4 – Offer and product information

All offers are without obligation. Obvious errors, mistakes, misprints or pricing errors do not bind Magnetenspecialist. Product images, technical drawings and product information are shown as accurately as possible but may deviate slightly from the delivered product. Magnetic values, pull forces and technical specifications are indicative and may depend on the application, surface, temperature and conditions of use.

Article 5 – Formation of the agreement

An agreement is formed as soon as the customer places an order and it is confirmed by Magnetenspecialist. Magnetenspecialist reserves the right to refuse an order or request additional information. If a product unexpectedly turns out to be unavailable, the customer will be informed as soon as possible.

Article 6 – Prices and payment

All prices on the website include VAT unless stated otherwise. Any shipping costs are stated separately at checkout. For orders under €5, a small-order surcharge of €2.95 (incl. VAT) is charged. It is shown in the cart and at checkout. Payment can be made using the payment methods offered on the website. Orders are processed after payment has been received, unless agreed otherwise in writing. For business customers, Magnetenspecialist reserves the right to carry out a credit check before allowing delivery on account.

Article 7 – Delivery and shipping

Magnetenspecialist aims to process and ship orders as quickly as possible. Products in stock that are ordered and paid for before 4 pm on a working day are generally shipped the same working day, unless stated otherwise on the product page. For custom products, specially ordered items or products with a different delivery time, the delivery time stated on the website applies. Delivery times are indicative and are not strict deadlines. Delivery takes place at the delivery address provided by the customer. Orders are usually shipped via GLS. Small products and light shipments may be sent as letterbox mail for reasons of sustainability and efficiency. The shipping method is determined based on dimensions, weight, destination and practical handling. Magnetenspecialist reserves the right to deliver an order in several shipments. The risk of loss or damage passes to the customer at the moment of delivery. Magnetenspecialist delivers within the Netherlands and other countries within the European Union.

Article 8 – Collection

Orders can only be collected by appointment. The customer is notified as soon as the order is ready for collection. Collection takes place on the agreed date and time.

Article 9 – Right of withdrawal for consumers

Consumers have the right to withdraw from the agreement within 30 days without giving any reason. The cooling-off period starts on the day the consumer, or a third party designated by them, receives the product. To exercise the right of withdrawal, the consumer registers the return within the withdrawal period by email to info@magnetenspecialist.nl, stating their name, order number and the product being returned.

Article 10 – Returns

After withdrawal, the product must be sent back within 30 days of registering the return. The return label and the cost of sending it back are borne by the customer, unless the product is damaged, defective or delivered incorrectly. A partial return is possible. The shipping costs paid for the order are refunded. Products must be returned, as far as reasonably possible, complete, undamaged and in their original packaging. Refunds are made within 14 days of receiving the return or after sufficient proof of shipment has been provided.

Article 11 – Exclusion of the right of withdrawal

The right of withdrawal does not apply to: specially manufactured products; custom products; products produced to the customer's specifications; specially ordered products that are not part of the standard range – unless the delivered product does not meet the agreed specifications.

Article 12 – Warranty and conformity

The statutory warranty applies to all products. Magnetenspecialist guarantees that delivered products comply with the agreement and the reasonable expectations the customer may have. The warranty lapses if damage results from: incorrect use, incorrect mounting, careless storage, dropping or impact, overloading, wear, or exposure to conditions for which the product is not suitable.

Article 13 – Properties of neodymium magnets

Neodymium magnets are very powerful magnets. Neodymium is a hard but relatively brittle material. Breakage, chipping or damage resulting from collision, dropping, pinching, incorrect use, overloading or incorrect mounting is not covered by the warranty. Customers must handle strong magnets with care and follow the safety instructions on the website and product pages.

Article 14 – Safety and use of magnets

Magnets can damage electronic equipment, data carriers and measuring instruments. Strong magnets must be kept away from: pacemakers and other medical implants, mobile phones, computers and laptops, hard drives, bank cards and other magnetic cards, and sensitive electronic equipment. Due to their strong attraction, magnets can unexpectedly move towards each other or strike metal objects. This may cause damage to products or materials, or physical injury. The customer is responsible for the safe use, mounting and storage of the delivered products.

Article 15 – Children and small parts

Magnets are not toys. Keep small magnets and magnet parts out of the reach of children. Swallowing magnets can cause serious injury and requires immediate medical attention.

Article 16 – Complaints

Complaints must be reported in writing or by email within a reasonable time after discovery. Business customers must report visible defects in writing within 8 days of receipt. Magnetenspecialist aims to respond to complaints within 14 days.

Article 17 – Liability

The liability of Magnetenspecialist is limited to the amount of the order concerned. Magnetenspecialist is not liable for indirect damage, consequential damage, loss of profit, business interruption or other forms of consequential loss. These limitations do not apply to damage caused by intent or deliberate recklessness. For consumers, these limitations apply only to the extent permitted by law.

Article 18 – Force majeure

Magnetenspecialist is not obliged to fulfil its obligations if this is impossible due to force majeure, including: disruptions at carriers, internet and network outages, government measures, strikes, natural disasters, war, pandemics and disruptions at suppliers.

Article 19 – Applicable law and disputes

All agreements are governed exclusively by Dutch law. Disputes are submitted to the competent court in the Netherlands. If the customer is a consumer, they also have the right to submit the dispute to a competent dispute resolution body where provided by law. Consumers also retain the protection of the mandatory provisions of the law of their country of residence.
